Patient Rights:
Right to “notice” of privacy practices
Right to access health information
Right to request amendment of health information
Right to an accounting of disclosures
Right to request restriction of uses, disclosures, means and locations
Patient Consent:
Providers must provide notice of privacy practices prior to using or disclosing personal health information to carry out treatment, payment or health care operations
Researchers must assure the patient or subject has received the privacy notice and has authorized access to his/her health information, unless a waiver has been obtained by the IRB
Patients must be given notice to “opt-out” of information sharing for fundraising and marketing, patient condition sharing, visitor information and clergy notification
Permitted uses and disclosures include situations of emergency, public health, law, victims of abuse, organ donation, and serious threats to health or safety
